Filing an injury claim does not automatically lead to a payment decision. An insurer may need to determine whether coverage applies, how the incident occurred, who was responsible, what injuries resulted from the event, and which claimed losses are supported by documentation. That process can involve information from the claimant, policyholder, witnesses, medical providers, and other records.

Someone consulting a Burbank personal injury attorney may therefore find that the claim is evaluated from several directions at once. California Department of Insurance guidance states that after an auto claim is filed, an insurance company may request detailed information, take a written or recorded statement, contact other drivers and witnesses, and require documentation of injuries, medical expenses, lost wages, and other losses in applicable claims.

The Investigation Starts With Coverage

Before evaluating how much an injury claim may be worth, an insurer may first determine whether the relevant policy provides coverage for the event.

The policy can identify insured drivers, covered vehicles, coverage limits, deductibles, exclusions, and other terms affecting the claim. The California Department of Insurance advises policyholders to review their declarations page and policy because those documents identify important coverage information.

This stage can involve basic questions such as whether the policy was in effect on the date of the incident, whether the person or vehicle involved falls within the coverage, and which particular coverage provisions apply.

Coverage and liability are separate issues. A person may believe another driver clearly caused an accident while the insurer still needs to determine which policy provisions govern the resulting claim.

Liability Evidence Can Affect How Responsibility Is Divided

An insurer may next examine how the injury-producing event happened.

In a vehicle collision, that investigation can include statements from the drivers, witness accounts, photographs, police information, vehicle damage, and other material relating to the events before and during the impact. California insurance guidance specifically notes that insurers may contact other drivers and witnesses during their investigation.

Responsibility is particularly significant when the evidence indicates that more than one person may have contributed to the incident. California recognizes comparative fault. The Judicial Council’s civil jury instructions explain that a claimant’s recovery may be reduced according to the share of negligence attributed to that claimant.

An insurer may therefore examine evidence that supports its insured’s responsibility as well as evidence suggesting that the injured person or another party contributed to the event.

The investigation is stronger when responsibility can be tied to specific facts rather than assumptions about who caused the accident.

Medical Records Help Connect the Injury to the Event

A claimed injury creates another set of questions. The insurer may need documentation showing what condition was diagnosed, when treatment began, what services were provided, and what medical expenses followed.

California’s court guidance identifies medical bills and doctor reports as evidence commonly relevant to personal injury cases. It also lists ongoing treatment and future injury-related problems among losses that may need to be considered.

The timing of medical care can become part of this review because the insurer is evaluating whether the claimed losses are connected to the event covered by the claim. Medical documentation can help establish what symptoms were reported, what providers observed, and how treatment progressed.

This does not mean every medical record necessarily determines the outcome of the claim. Medical evidence is one part of a larger investigation that may also include the claimant’s account, accident records, and other supporting documentation.

The Amount Claimed Needs Supporting Documentation

An insurer evaluating an injury claim may distinguish between the existence of an injury and the amount of the resulting financial loss.

Medical bills can document treatment expenses. Wage and employment records can help establish income lost because of an injury. Receipts and other records may support additional out-of-pocket expenses.

California’s personal injury guidance identifies several categories of potential loss:

  • Medical bills
  • Lost wages
  • Ongoing treatment
  • Emotional harm
  • Future problems resulting from the injury

Some losses can be established directly through bills or similar records, while others require different forms of proof.

For an insurance investigation, documentation makes it possible to compare the amount being requested with evidence showing what the claimant actually experienced or paid.

Statements May Be Compared With Other Information

Insurance investigations can involve statements from several people rather than relying solely on the injured person’s initial description.

The California Department of Insurance explains that an insurer may obtain a written or recorded statement from its claimant and may contact other drivers or witnesses. That creates several information sources that can be compared with photographs, reports, medical documentation, and other evidence.

Differences do not automatically mean someone is being dishonest. People may observe an event from different locations or remember details differently. However, a significant inconsistency can lead to additional questions when it concerns a fact that affects liability, coverage, or damages.

Keeping descriptions factual is therefore useful. A claimant does not need to speculate about speed, distances, medical diagnoses, or another person’s intentions when those facts are unknown.

Insurers Are Expected to Conduct a Reasonable Claims Investigation

Claim investigations are not unlimited exercises designed solely to find reasons to reject a claim. California regulates how insurers handle claims.

The California Department of Insurance maintains Fair Claims Settlement Practices Regulations covering insurer duties, claims-file documentation, communications, and standards for prompt, fair, and equitable settlements. The department also examines insurers’ claim files and handling procedures for compliance with California statutes and regulations.

Those requirements matter because an insurer’s conclusion is expected to come from an investigation of the claim rather than an unsupported assumption.

The insurer’s claim file can contain correspondence, notes, documents, and other material connected with its handling of the matter. California’s Insurance Commissioner has described state rules requiring claim files to contain information in enough detail for relevant events and the insurer’s actions to be reconstructed.
